Terms and Conditions

Australian Governments have developed legislation in each State and Territory governing the conduct of fundraising (the Fundraising Acts). Under the Fundraising Acts, anyone wishing to raise money for charitable purposes on behalf of another organisation must hold an authority to fundraise issued by that organisation. 

All fundraising activities must meet the requirements of relevant laws and regulations in your State/Territory and you will need to obtain any necessary permits or licenses required. 

We suggest you contact your local State Authority for more information. 

            Anyone running a fundraising event must consider licenses, permits, local council approvals and insurance. If your activity is using raffles, lotteries or other gaming activities to fundraise, there may be other laws and obligations that apply in your State/Territory. 

            Before you get started with planning your fundraising event for Canteen, we will need to authorise your fundraising activity/event. Due to this being an online event through our online portal your event is automatically approved. You will not receive an official written Authority to Fundraise. Canteen will review your event upon creation and remove/decline any that do not meet the standards and approval criteria. 

            In order to be an approved fundraiser on behalf of Canteen you will need to review and agree with the below conditions - 

            • RESPONSIBILITY The activity/event is the sole responsibility of you, the fundraiser and is to be conducted in the name of the Fundraiser; this includes financial and legal aspects. Canteen, due to limited resources, is not able to take a coordination role in your activity/event and therefore cannot assist with ticket sales or soliciting prizes. 
            • CHANGES TO APPLICATION Any changes to the information provided at set up must be forwarded to Canteen in writing for review prior to the activity/event taking place. Canteen reserves the right to withdraw approval of an activity/event if it feels the fundraiser is not complying with the rules and guidelines set out in this document. 
            • FUNDRAISING IN PUBLIC Canteen does not allow individuals organising or participating in a fundraising event/activity to solicit sponsorship for their personal fundraising goals in public areas. 
            • USE OF LOGO Any use of Canteen name and dedicated fundraising ‘Proudly Supporting logo’ must be supplied to Canteen prior to printing or circulation for approval. The only logo that is permitted to be used is the ‘Proudly Supporting Logo’. 
            • TAX DEDUCTIBLE RECEIPTS A tax deductible receipt can only be provided to someone who makes a donation without receiving a material benefit.  A person cannot be provided with a tax deductible receipt for donations made to a raffle, auction or if the person provides goods, a service or general cash for sponsorship. Online donations will be automatically receipted to the email address provided when the donation is made. 
            • INSURANCE Canteen is unable to provide public liability insurance cover to community fundraising events and/or coordinators. It is the responsibility of the event coordinator to arrange this in conjunction with the venue. 
            • USE OF YOUR INFORMATION Canteen uses your information to process donations and communicate with you about your support and our work. We will only disclose this information with service providers to fulfil activities to our fundraising or if required by the law. For more information you can read our privacy policy here. Creating an account automatically opts you in, you can unsubscribe at any time.  

                        All fundraising activities approved by Canteen must comply with all relevant Australian Federal and State Laws. Whilst we would like to be able to approve all applications, there may be some activities which do not adhere to our fundraising and ethical guidelines and would therefore not be accepted. 

                        These include but may not be limited to any fundraising activities: 

                        • That promote gambling, alcohol, smoking and tobacco 
                        • That promote fundraising via the sale of alcohol direct to the public 
                        • That promotes/exhibits any nudity, semi-nudity or sexual imagery
                        • That promotes violence in any form or cruelty to animals 
                        • That results in a potential negative impact on the environment 
                        • That involves a high level of personal or public risk 

                                  Where the logo is used for packaging of a product or on a product and sold in a retail environment without an established corporate partnership agreement 

                                  If the activity goes against the brand and ethical guidelines of Canteen 

                                  By checking the tick box you agree to the above mentioned terms and conditions and to conduct the activity/event in accordance with these conditions and understand that Canteen reserves the right to withdraw approval of this activity/event if I fail to do so.

                                  Five Peaks Virtual Challenge 

                                  Five Peaks Virtual Challenge is a fundraising initiative owned and operated by Canteen Australia. 

                                  The Challenge:

                                  1. The challenge starts on 1 March 2025 and ends on 31 March 2025.
                                  2. To be eligible to receive rewards, Five Peaks Virtual Challenge fundraisers need to meet the conditions outlined below (under "Rewards") by 11:59pm AEDT on 15 April 2025.
                                  3. While participating in this challenge may have health benefits, Five Peaks Virtual Challenge provides no warranty whatsoever that this challenge will achieve an individual's health goals. The challenge has not been developed with any individual's particular health requirements in consideration.
                                  4. Do not rely on the information provided in relation to Five Peaks Virtual Challenge as an alternative to medical advice from a doctor or other professional healthcare provider. If participants have any specific health or medical concerns, they should consult with their medical or healthcare provider, prior to changing their diet, nutrition, or exercise regimen.
                                  5. While Canteen Australia has made every attempt to ensure that the information provided as part of Five Peaks Virtual Challenge has been obtained from reliable sources, Canteen Australia is not responsible for any errors or omissions, or for the results obtained from the use of this information. 

                                  Agreement: 

                                  I/We understand the terms and conditions under which any fundraising activities benefiting Canteen Australia need to operate. I/We have read Canteen Australia’s terms and conditions and offer to participate in Five Peaks Virtual Challenge in accordance with those terms and conditions. 

                                  By agreeing to these Terms of Fundraising you acknowledge:

                                  1. Will be solely responsible for all your activities on the fivepeaks.org.au site also referred to as the Site.
                                  2. No person under the age of 16 may use fivepekas.org.au to donate or fundraise, unless the permission of a parent or guardian is sought to participate in the challenge.
                                  3. You do not have any pending/current charges or past criminal convictions relating to a sexual offence. You do not have any convictions of a violent nature or assault. You have never been convicted, with or without trial of, pleaded guilty or no contest to a theft or fraud charge. You are not currently awaiting or attending a trial or been arrested for a theft, fraud charge, sexual offence, assault or crime of a violent nature.
                                  4. You will be solely responsible for all your activities on the fivepekas.org.au site also referred to as the Site;
                                  5. You have the legal capacity to enter these terms;
                                  6. You will keep all passwords, account names, log-in identifiers required to access fivepeaks.org.au secure and confidential;
                                  7. You will not use fivepeaks.org.au in any way that causes, or is likely to cause, the site or access to it to be interrupted, damaged or impaired in any way.
                                  8. You will not use the site to misrepresent your identity or affiliation with any person or organisation;
                                  9. You will not use the Site to conduct, display or forward details of any survey, contest, pyramid scheme or chain letter or use any part of our Site to send commercial messages in contradiction of the Spam Act 2003 (Cth)
                                  10. You will not attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the site, any associated website or any other website.
                                  11. You will not hide, deface, alter or delete any copyright symbol, trademark or other proprietary rights notice;
                                  12. You will not use any part of the Site which you are not authorised to use or devise ways to circumvent security in order to access part of the Site which you are not authorised to access. This includes, but is not limited to, scanning networks with the intent to breach and/or evaluate security, whether or not the intrusion results in access.
                                  13. You will not use or attempt to use the Site for any unlawful, criminal or negligent purpose. This includes, but is not limited to, password cracking, social engineering (defrauding others into releasing their passwords), denial-of-service attacks, harmful and malicious destruction of data, infringing the intellectual property rights of any person, and injection of computer viruses and intentional invasion of privacy.
                                  14. Canteen Australia requires that there be no door-to-door appeals, street collections or telephone solicitation of any kind to the public in connection with the National Bandanna Day challenge.
                                  15. You agree to comply with all applicable Fundraising Acts, other laws, regulations and by-laws (including all applicable privacy laws) and any other conditions which we may notify to you. In participating in the Five Peaks Virtual Challenge, you agree to refrain from doing anything which may reasonably be expected to damage the goofacdwill, reputation or integrity of Five Peaks Virtual Challenge. 

                                  Disclaimer: 

                                  Five Peaks Virtual Challenge reserves the right to withdraw approval to fundraise should it be necessary to protect its reputation. 
                                   
                                  Rewards: 

                                  1. Rewards open to all Australian Five Peaks Virtual Challenge participants and managed organisiations who register on fivepeaks.org.au 
                                  2. To be eligible to receive a reward, Five Peaks Virtual Challenge fundraisers need to meet the conditions outlined below between Monday 5 August and 11:59pm AEST and 15 April 2025. 
                                  3. Canteen Australia will not send rewards to addresses outside of Australia. 
                                  4. Reward recipients will be notified via their registered email. 
                                  5. The individual fundraising targets that are required to be eligible to receive rewards include:
                                    Raise $1 – Receive a FREE Canteen bandanna.
                                    Raise $250 – eligible to claim an exclusive Canteen supporter keyring
                                    Raise $500 – eligible to claim an exclusive Stand up to Cancer T-Shirt (size must be selected and no exchanges permitted once selection made)
                                    Raise $1000 – eligible to claim an exclusive Canteen travel mug  
                                  6. Prizes are as stated, and no cash or other alternatives will be offered. Prizes are not transferrable.
                                  7. The promoter's decision is final, and no correspondence will be entered into. The promoter is Canteen Australia, ABN 77 052 040 516.
